Do You Know About Bill 168?

The Act to amend the OHSA with respect to violence and harassment in the workplace and other matters (Bill 168) was finalized upon receiving Royal Assent on December 15th, 2009. The Bill 168 will take into effect on June 15th, 2010. Bill 168 will impose new obligations regarding workplace violence for Ontario employers where more than 5 workers are regularly employed.

The legislation will require employers to:

1. Complete a risk assessment of violence hazards in the workplace
2. Develop violence and harassment policies and procedures
3. Implement worker violence and harassment reporting procedures
4. Create incident investigation procedures
5. Have emergency response procedures in place in the event of violence
6. Put into practice processes on how to deal with incidents and complaints of violence.
